2.2 Delivery Services
Dewey's Pizza may offer delivery services directly or through authorized third-party delivery partners. Delivery availability, estimated times, minimum order requirements, and delivery fees are presented at the time of checkout. Estimated delivery times are approximations only and are not guaranteed. Actual delivery times may vary due to weather conditions, traffic, order volume, or other factors outside our control.
2.3 Carryout Orders
Customers may place orders online, by phone, or in person for carryout at our participating locations. Carryout orders must be picked up within a reasonable time after the estimated ready time. Dewey's Pizza is not responsible for food quality deterioration resulting from delayed pickup by the customer.
2.4 Catering and Special Orders
We may offer catering packages and special event orders subject to availability and separate pricing agreements. Catering orders may require advance notice, a deposit, and may be subject to additional terms communicated at the time of ordering.
2.5 Loyalty and Promotional Programs

4. User Obligations and Prohibited Activities

4.1 Prohibited Conduct
- Use the Website for any unlawful purpose or in violation of any federal, state, or local regulations;
- Engage in fraudulent activity, including but not limited to placing false orders, submitting fraudulent payment information, or claiming unwarranted refunds or chargebacks;
- Impersonate any person or entity or falsely represent your affiliation with any person or entity;
- Harvest, scrape, or collect data from the Website using automated tools, bots, crawlers, or data mining techniques without our express written consent;
- Transmit any unsolicited commercial communications (spam) using our platform or contact information;
- Attempt to gain unauthorized access to any portion of our systems, servers, databases, or networks;
- Introduce viruses, malware, ransomware, or any other malicious code into our systems;
- Circumvent or attempt to circumvent any security or authentication measures on the Website;

5. Payment Terms
5.1 Pricing
All prices displayed on our Website are in United States Dollars (USD) and are inclusive of applicable sales tax where required by law. Prices are subject to change at any time without prior notice. The price of your order will be confirmed at checkout prior to your final submission of payment. Menu items and pricing available online may differ from in-store pricing at certain locations.

5.3 Order Confirmation

If payment has already been processed and your order is cancelled by us, we will issue a full refund to your original payment method.
5.4 Refunds and Cancellations
Due to the perishable nature of food products, all sales are generally final once food preparation has commenced. Refunds, credits, or replacements are handled on a case-by-case basis at our sole discretion. We do not guarantee refunds for orders where the customer provided incorrect delivery information or failed to pick up a carryout order in a timely manner.

6.4 User-Generated Content

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE UNITED STATES LAW, IN NO EVENT SHALL DEWEY'S PIZZA, ITS OWNERS, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AFFILIATES, SUPPLIERS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, REVENUE, GOODWILL, DATA, BUSINESS INTERRUPTION, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE WEBSITE OR SERVICES, EVEN IF DEWEY'S PIZZA HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
IN ANY EVENT, DEWEY'S PIZZA'S TOTAL CUMULATIVE LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THESE TERMS OR YOUR USE OF OUR SERVICES SHALL NOT EXCEED THE GREATER OF: (A) THE TOTAL AMOUNT YOU PAID TO DEWEY'S PIZZA IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE CLAIM; OR (B) ONE HUNDRED UNITED STATES DOLLARS ($100.00).
Some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages, so the above limitations may not apply to you in their entirety. In such jurisdictions, our liability shall be limited to the fullest extent permitted by applicable law.
Nothing in these Terms shall limit or exclude Dewey's Pizza's liability for: (i) personal injury or death caused by our negligence; (ii) fraud or fraudulent misrepresentation; or (iii) any other liability that cannot be excluded or limited under applicable law, including consumer protection laws enforced by the Federal Trade Commission (FTC) under the FTC Act (15 U.S.C. § 41 et seq.).
10. Indemnification
You agree to defend, indemnify, and hold harmless Dewey's Pizza, its owners, officers, directors, employees, agents, affiliates, licensors, and service providers from and against any and all claims, liabilities, damages, judgments, awards, losses, costs, expenses, and fees (including reasonable attorneys' fees) arising out of or relating to:

If you are a consumer residing in a specific state, you may also have rights under applicable state consumer protection laws. For example, residents of California may have additional rights under the California Consumer Privacy Act (CCPA/CPRA) and California's consumer protection statutes. These state-specific rights are not waived by these Terms.
12. Dispute Resolution and Arbitration
12.1 Informal Resolution
Before initiating any formal legal proceedings, you agree to first contact Dewey's Pizza in writing at [email protected] and provide a written description of the dispute, the basis for your claim, and the relief you are seeking. We will attempt to resolve the dispute informally within thirty (30) days of receiving your written notice. If we are unable to reach a resolution within this period, either party may proceed with formal dispute resolution as outlined below.
12.2 Binding Arbitration
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.
Except for disputes that qualify for small claims court, you and Dewey's Pizza agree that any and all disputes, claims, or controversies arising out of or relating to these Terms, your use of the Website, or the Services shall be resolved exclusively through binding individual arbitration, rather than in court. The arbitration shall be administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, which are available at www.adr.org. 12.3 Class Action Waiver
YOU AND DEWEY'S PIZZA EACH AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. If for any reason a claim proceeds in court rather than in arbitration, you and Dewey's Pizza each waive any right to a jury trial and waive any right to bring or participate in a class action lawsuit. If applicable law prohibits this class action waiver for a particular claim, that claim shall be severed from the arbitration agreement and proceed in a court of competent jurisdiction.
12.4 Exceptions
Notwithstanding the foregoing, either party may seek emergency injunctive or other equitable relief from a court of competent jurisdiction to prevent the actual or threatened infringement of intellectual property rights or other irreparable harm. You may also bring individual claims in small claims court if the claim qualifies and remains in small claims court.

20. Assignment
You may not assign or transfer these Terms or any rights or obligations herein, whether by operation of law or otherwise, without the prior written consent of Dewey's Pizza. Any purported assignment in violation of this section shall be null and void.
